US Regulators Approve Rule That Could Speed Renewables (npr.org) 23

Longtime Slashdot reader necro81 writes: The U.S. Federal Energy Regulatory Commission (FERC), which controls interstate energy infrastructure, approved a rule Monday that should boost new transmission infrastructure and make it easier to connect renewable energy projects. Some 11,000 projects totaling 2,600 GW of capacity are in planning, waiting to break ground, or connect to the grid. But they're stymied by the need for costly upgrades, or simply waiting for review. The frustrations are many. Each proposed project undergoes a lengthy grid-impact study and assessed the cost of necessary upgrades. Each project is considered in isolation, regardless of whether similar projects are happening nearby that could share the upgrade costs or auger different improvements. The planning process tends to be reactive -- examining only the applications in front of them -- rather than considering trends over the coming years. It's a first-come, first-served queue: if one project is ready to break ground, it must wait behind another project that's still securing funding or permitting.

Two years in development, the dryly-named Improvements to Generator Interconnection Procedures and Agreements directs utility operators to plan infrastructure improvements with a 20-yr forecast of new energy sources and increased demand. Rather than examining each project in isolation, similar projects will be clustered and examined together. Instead of a First-Come, First-Served serial process, operators will instead examine First-Ready, allowing shovel-ready projects to jump the queue. The expectation is that these new rules will speed up and streamline the process of developing and connecting new energy projects through more holistic planning, penalties for delays, sensible cost-sharing for upgrades, and justification for long-term investments.

Walmart's Reign as America's Biggest Retailer Is Under Threat (wsj.com) 48

With Amazon on its heels, the nation's biggest company by revenue is hunting for ways to continue growing. From a report: For a decade, Walmart has reigned as the nation's biggest company by revenue. Its sales last year added up to $648 billion -- more than $1.2 million a minute. That status comes with benefits. It gives Walmart power in negotiations with product manufacturers and in dealing with government officials over policy issues. It's also a point of pride: Job postings often tout working at the "Fortune 1" company as a perk. Its reign is looking shaky lately [non-paywalled link]. If current sales trends persist, Amazon is likely to overtake Walmart soon. Amazon reported $575 billion in total revenue last year, up 12% from the previous year, compared with Walmart's revenue growth of 6%.

Walmart's behemoth size means that to meet its own sales target of around 4% growth each year, the company has to find an additional $26 billion in sales this year. That's no easy task. About 90% of Americans already shop at the retailer. The pandemic and rising inflation boosted Walmart's revenue by $100 billion since 2019. It faces continued uncertainty in consumer confidence and while it's spending in some areas, it's pulling back in others. Earlier this week, Walmart told workers it would cut hundreds of corporate jobs and ask most remote workers to move to offices. While Amazon's and Walmart's businesses compete head on, there are big differences. Amazon earns much of its profit from non-retail operations such as cloud computing and advertising, while grabbing retail market share with fast shipping. Walmart gets the bulk of its sales and profits from U.S. stores, while growing side businesses like advertising and digital sales.

Walmart executives are most wary of Amazon's ability to keep increasing profits through its non-retail business, while eating more of the retail landscape with ever-faster shipping and a bigger product selection, people familiar with the company said. Internally some executives are highlighting Walmart's role as a good corporate citizen and emphasizing that it's important to be the best at serving customers and workers, not just the biggest, say some of those people. Its scale can also have downsides, say some, like outsize attention on every misstep.

Senators Urge $32 Billion in Emergency Spending on AI After Finishing Yearlong Review (apnews.com) 110

A bipartisan group of four senators led by Majority Leader Chuck Schumer is recommending that Congress spend at least $32 billion over the next three years to develop AI and place safeguards around it, writing in a report released Wednesday that the U.S. needs to "harness the opportunities and address the risks" of the quickly developing technology. AP: The group of two Democrats and two Republicans said in an interview Tuesday that while they sometimes disagreed on the best paths forward, it was imperative to find consensus with the technology taking off and other countries like China investing heavily in its development. They settled on a raft of broad policy recommendations that were included in their 33-page report. While any legislation related to AI will be difficult to pass, especially in an election year and in a divided Congress, the senators said that regulation and incentives for innovation are urgently needed.

Boeing May Face Criminal Prosecution Over 737 Max Crashes, US Says (bbc.com) 62

The Department of Justice says it is considering whether to prosecute Boeing over two deadly crashes involving its 737 Max aircraft. From a report: The aviation giant breached the terms of an agreement made in 2021 that shielded the firm from criminal charges linked to the incidents, the DOJ said. Boeing has denied that it violated the agreement. The crashes - one in Indonesia in 2018, and another in Ethiopia in 2019 - killed a total of 346 people.

The plane maker failed to "design, implement, and enforce a compliance and ethics program to prevent and detect violations of the US fraud laws throughout its operations," the DOJ said. Boeing said it was looking forward to the opportunity to respond to the Justice Department and "believes it honoured the terms of that agreement." Under the deal, Boeing paid a $2.5bn settlement, while prosecutors agreed to ask the court to drop a criminal charge after a period of three years. The DOJ said Boeing has until 13 June to respond to the allegations and that what it said would be taken into consideration as it decides what to do next.

G5 Severe Geomagnetic Storm Watch Issued For First Time Since 2003 (axios.com) 32

Longtime Slashdot reader davidwr shares a report from Space Weather Prediction Center (SWPC): On Thursday, May 9, 2024, the NOAA Space Weather Prediction Center issued a Severe (G4) Geomagnetic Storm Watch. At least five earth-directed coronal mass ejections (CMEs) were observed and expected to arrive as early as midday Friday, May 10, 2024, and persist through Sunday, May 12, 2024. Several strong flares have been observed over the past few days and were associated with a large and magnetically complex sunspot cluster (NOAA region 3664), which is 16 times the diameter of Earth. [The agency notes this is the first time it's issued a G4 watch since January, 2005.] "Geomagnetic storms can impact infrastructure in near-Earth orbit and on Earth's surface, potentially disrupting communications, the electric power grid, navigation, radio and satellite operations," NOAA said. "[The Space Weather Prediction Center] has notified the operators of these systems so they can take protective action." The agency said it will continue to monitor the ongoing storm and "provide additional warnings as necessary."

A visual byproduct of the storm will be "spectacular displays of aurora," also known as the Northern Lights, that could be seen for much of the northern half of the country "as far south as Alabama to northern California," said the NOAA. "Northern Montana, Minnesota, Wisconsin and the majority of North Dakota appear to have the best chances to see it," reports Axios, citing the SWPC's aurora viewline. "Forecast models Friday showed the activity will likely be the strongest from Friday night to Saturday morning Eastern time."

UPDATE 6:54 P.M. EDT: G5 conditions have been observed -- the first time since 2003, says Broadcast Meteorologist James Spann.

The Automotive Cold War Is Officially Underway (insideevs.com) 170

Tim Levin reports via InsideEVs: Two things of note in the electric vehicle world happened today around the same time. First, the Geely Group-owned Chinese EV brand Zeekr debuted on the New York Stock Exchange today at a valuation of around $5.2 billion. Then, around 250 miles south in Washington, D.C., news emerged that the Biden Administration is set to quadruple tariffs on Chinese-made electric cars if they hit American roads. The timing may be purely coincidental. But after this week, one thing feels clearer than ever: the automotive Cold War between China and the West is fully underway, and EVs specifically are at the center of it all.

The Wall Street Journal got the scoop that the White House plans to announce higher tariffs on Chinese clean-energy imports in the coming days. Under the reported new policies, tariffs on Chinese EVs are set to quadruple, rising from the current 25% to a whopping 100%, anonymous sources told the outlet. In theory, that would substantially increase the cost of any Chinese-made EVs on our market, including, potentially, ones sold by known Western and other Asian brands. It's no secret why the U.S. is attempting to push back on Chinese EVs, to say nothing of other clean energy imports from that country like solar panels. China has spent years aggressively building up its capacity to manufacture electric cars. It's developed a stranglehold on the supply chains for lithium-ion batteries and the critical minerals they contain. It has lavished state incentives on both EV production and purchasing. In recent years, the country has emerged as a global EV powerhouse -- and, for the first time ever, an exporter on par with leaders like Japan and Germany.

Many still believe that China's cars are cheap and technologically subpar. But the truth is China has learned to build cars very, very well, as InsideEVs' own Kevin Williams discovered during a recent trip to the Beijing auto show. China's homegrown electrified vehicles range from the inexpensive -- some, like the BYD Seagull, cost less than $10,000 in their home market -- to higher-end, luxury-focused offerings like the Yangwang U8, a kind of plug-in hybrid competitor to the Mercedes G-Class that can "float" on water. From batteries to software, most are incredibly advanced. Car companies and policymakers in the U.S. (and Europe) say these cars pose a real threat to our nascent EV market, where many options still remain unaffordable and things like batteries and software are works in progress. In response, European Union officials have also launched investigations into Chinese imports that could lead to stronger tariffs.
"In effect, the tariffs may end up buying the U.S. some time, rather than being a permanent solution here," concludes Levin. "After all, as Kevin Williams pointed out after going to Beijing: all of these crackdowns aren't guaranteed to yield better cars from Ford, General Motors and the rest."

According to the WSJ, the new tariffs on Chinese goods will also apply to solar panels, batteries and critical battery minerals. They're expected to be announced as soon as next week.

Chemicals In Car Interiors May Cause Cancer, and They're Required By US Law (thehill.com) 60

An anonymous reader quotes a report from The Hill: Tens of millions of Americans each day breathe in carcinogenic chemicals that are woven into the interiors of their cars, a new study has found. While opening a window can help reduce the risk, only reforms can keep people safe, researchers wrote in a study in Environmental Science and Technology. Approximately 124 million Americans commute each day, spending an average of an hour in their cars. By federal law, the interior of these vehicles are required to contain flame retardants, or chemicals that make it harder for them to combust in a crash. These chemicals have been a legally mandated part of modern cars since the 1970s, when the National Highway Traffic Safety Administration (NHTSA) passed a law requiring their use.

It's arguable how effective this protection is. Patrick Morrison, of the International Association of Firefighters, said in a statement on the study that these chemicals do little to prevent blazes -- but instead simply make them "smokier and more toxic." What the study conclusively demonstrates is that any such protection comes at a price. Virtually all cars investigated by Duke University researchers contained the chemical tris (1-chloro-isopropyl) phosphate, or TCIPP -- which the U.S. National Toxicology Program is investigating as a potential carcinogen. Most cars also had two other phosphate-based flame retardants that the state of California is investigating as potential carcinogens: Those chemicals are tris (1,3-dichloro-2-propyl) phosphate (TDCIPP) and tris (2-chloroethyl) phosphate (TCEP). All three chemicals are linked to reproductive and neurological problems -- particularly because they don't stay in the fabrics they're woven into. Flame retardant chemicals off-gas or leach from the seat and interior fabrics into the air, -- especially in hot weather, when car interiors can reach 150 degrees Fahrenheit.
A study from 2017 found that the average U.S. child has lost up to 5 IQ points from exposure to flame retardants in cars and furniture. Meanwhile, adults with the highest levels of flame retardants in their blood face a risk of death by cancer that is four times greater than those with the lowest levels, according to a study published last month.

Texas Spot Power Prices Jump Almost 100-Fold On Tight Supply (yahoo.com) 127

ArchieBunker quotes a report from Bloomberg: Texas electricity prices soared almost 100-fold as a high number of power-plant outages raised concerns of a potential evening shortfall. Spot prices at the North Hub, which includes Dallas, jumped to more than $3,000 a megawatt-hour just before 7 p.m. local time, versus about $32 at the same time Tuesday, according to data from the Electric Reliability Council of Texas. This morning, Ercot, as the state's main grid operator is known, issued a "watch" for a potential capacity reserve shortage from about 7-9 p.m., meaning the buffer of spare supplies could fall to low enough levels to call on back-up generation, cancel or delay outages or curb usage.

The conditions are the tightest of the year so far and raises the risk of prices rising to the $5,000 cap -- which they last did on April 16, when Ercot also warned of a potential shortfall. Unusually hot weather in the region has boosted demand for cooling and lowered the efficiency of many power plants. Wind output has also fallen from a day earlier and there are more outages. "Ercot has not called for conservation this evening," it said by email. "The grid is operating under normal conditions at this time."

81% of Young People Say a 4-Day Workweek Would Boost Productivity, Survey Finds (cnbc.com) 206

A new national survey (PDF) from CNBC/Generation Lab of 1,033 people aged 18 to 34 found that an overwhelming 81% of respondents believe a four-day workweek would boost their company's productivity, while 19% said productivity would decline. CNBC reports: Those results from the "Youth & Money in the USA" survey come amid discussions around the potential benefits of switching from the standard five-day U.S. workweek to a four-day cadence without a pay cut. Some companies have begun testing the arrangement, and say it has mitigated employee burnout and strengthened business performance. Exos, a U.S. coaching company that trains top athletes and leads corporate wellness programs, recently reported results from the first six months of an ongoing four-day workweek experiment. The company said the shortened workweek increased efficiency along with revenue and retention.

Although respondents to the CNBC/Generation Lab survey largely agreed on workweek length, they were less unified when asked about work setting. A 60% majority said they do their best work in the office, while the other 40% said they do so at home.

US Eyes Curbs on China's Access To AI Software Behind Apps Like ChatGPT (reuters.com) 27

The Biden administration is poised to open up a new front in its effort to safeguard U.S. AI from China with preliminary plans to place guardrails around the most advanced AI models, the core software of artificial intelligence systems like ChatGPT, Reuters reported Wednesday. From the report: The Commerce Department is considering a new regulatory push to restrict the export of proprietary or closed source AI models, whose software and the data it is trained on are kept under wraps, three people familiar with the matter said. Any action would complement a series of measures put in place over the last two years to block the export of sophisticated AI chips to China in an effort to slow Beijing's development of the cutting edge technology for military purposes. Even so, it will be hard for regulators to keep pace with the industry's fast-moving developments.

Currently, nothing is stopping U.S. AI giants like Microsoft-backed OpenAI, Alphabet's Google DeepMind and rival Anthropic, which have developed some of the most powerful closed source AI models, from selling them to almost anyone in the world without government oversight. Government and private sector researchers worry U.S. adversaries could use the models, which mine vast amounts of text and images to summarize information and generate content, to wage aggressive cyber attacks or even create potent biological weapons. To develop an export control on AI models, the sources said the U.S. may turn to a threshold contained in an AI executive order issued last October that is based on the amount of computing power it takes to train a model. When that level is reached, a developer must report its AI model development plans and provide test results to the Commerce Department.

US Revokes Intel, Qualcomm Licenses To Sell Chips To Huawei (msn.com) 241

An anonymous reader quotes a report from MSN: The US has revoked licenses allowing Huawei to buy semiconductors from Qualcomm and Intel, according to people familiar with the matter, further tightening export restrictions against the Chinese telecom equipment maker. Withdrawal of the licenses affects US sales of chips for use in Huawei phones and laptops, according to the people, who discussed the move on condition of anonymity. House Foreign Affairs Committee Chairman Michael McCaul confirmed the administration's decision in an interview Tuesday. He said the move is key to preventing China from developing advanced AI. "It's blocking any chips sold to Huawei," said McCaul, a Texas Republican who was briefed about the license decisions for Intel and Qualcomm. "Those are two companies we've always worried about being a little too close to China."

While the decision may not affect a significant volume of chips, it underscores the US government's determination to curtail China's access to a broad swathe of semiconductor technology. Officials are also considering sanctions against six Chinese firms that they suspect could supply chips to Huawei, which has been on a US trade restrictions list since 2019. [...] Qualcomm recently said that its business with Huawei is already limited and will soon shrink to nothing. It has been allowed to supply the Chinese company with chips that provide older 4G network connections. It's prohibited from selling ones that allow more advanced 5G access.

Amazon's Delivery Drones Won't Fly In Arizona's Summer Heat (wired.com) 24

An anonymous reader quotes a report from Wired: Amazon plans to start flying delivery drones in Arizona this year -- but don't count on them to bring you a refreshing drink on a hot day. The hexacopter can't operate when temperatures top 104 degrees Fahrenheit, or 40 degrees Celsius, the company says, and average daily highs exceed that for three months of the year in Tolleson, the city outside Phoenix where Amazon is preparing to offer aerial deliveries from inside a 7.5-mile radius. The drones can't help with midnight snacks either, because they'll be grounded after sunset. Potentially being inoperable for a quarter of the year might make launching drone deliveries in Tolleson and neighboring desert communities seem like an odd choice. It's far from the first challenge faced by Amazon's much-delayed drone project. The unit is years behind its goals of flying items to customers in under an hour on a regular basis, and a one-time target of 500 million deliveries by 2030 seems distant. Amazon Prime Air has completed just thousands of deliveries, falling behind rivals; Alphabet subsidiary Wing has notched hundreds of thousands of delivery flights and Walmart more than 20,000.

In the California wine country town of Lockeford, where Amazon initially launched drone deliveries, some residents told WIRED last year that they ordered only because Amazon lured them with gift cards. In Arizona, it could be discouraging not being able to rely on drones during those hours when one might not want to venture too far from the comfort of air conditioning. [...] That temperature and other environmental conditions could ground or hamper the drone industry has been known for years. A team from University of Calgary's geography department estimated that on average across the world, drones with limitations similar to Amazon's, including from weather and daylight, would be limited to flying about 2 hours a day. In the world's 100 most populous cities, the average daily flight time would be 6 hours. "Weather is an important and poorly resolved factor that may affect ambitions to expand drone operations," they wrote in a study published in 2021. Heat, in particular, forces motors to work harder to keep drones aloft, and their batteries are only so powerful.

TikTok Sues US Government Over Law Forcing Sale or Ban (nytimes.com) 169

Less than two weeks after President Biden signed a bill that will force TikTok's Chinese owner, ByteDance, to sell the popular social media app or face a ban in the United States, TikTok said it sued the federal government on Tuesday, arguing the law was unconstitutional. From a report: TikTok said that the law violated the First Amendment by effectively removing an app that millions of Americans use to share their views and communicate freely. It also argued that a divestiture was "simply not possible," especially within the law's 270-day timeline, pointing to difficulties such as Beijing's refusal to sell a key feature that powers TikTok in the United States.

"For the first time in history, Congress has enacted a law that subjects a single, named speech platform to a permanent, nationwide ban, and bars every American from participating in a unique online community with more than one billion people worldwide," the company said in the 67-page petition it provided, which initiates the lawsuit. "There is no question: The act will force a shutdown of TikTok by Jan. 19, 2025." TikTok is battling for its survival in the United States, with the fight set to play out primarily in courts over the next few months. While lawmakers who passed the bill have said the app is a national security threat because of its ties to China, the courts must now weigh those concerns against TikTok's argument that a sale or ban would violate the First Amendment free-speech rights of its users and hurt small businesses that owe their livelihood to the platform.

America's Federal Regulators Are Preparing More Lawsuits Against Crypto Companies (politico.com) 23

A "string of legal victories" by America's market-regulating Securities and Exchange Commission "has jolted some of crypto's biggest players," reports Politico — even as they're seeking more credibility with U.S. lawmakers: Judges have recently rebuked claims that the SEC lacks authority to police the market. Coinbase, the largest U.S. exchange, lost a bid to throw out charges that it is violating investor-protection rules. And a New York jury found one-time billionaire entrepreneur Do Kwon and his firm liable for fraud. Now, the crackdown is about to expand, with the SEC preparing for a new round of lawsuits. "The SEC just keeps winning," said John Reed Stark, a former agency attorney and prominent crypto critic. "The law is catching up...."

[I]t's the SEC crackdown that is raising foundational questions about crypto's future. [SEC Chairman Gary] Gensler has been among the industry's most implacable foes, saying most crypto tokens are unregistered securities that are being sold illegally and blasting the industry as "rife with fraud, scams, bankruptcies and money laundering." His opposition has been so unwavering that many in the industry are holding out hope that he leaves the agency after the November elections...

[T]he SEC's enforcement sweep appears to be on the brink of spreading across the crypto world. Consensys is facing potential charges from the agency, according to the company's lawsuit. And the SEC recently warned Uniswap Labs, a decentralized finance company that created one of the world's largest DeFi exchanges, that staff was preparing to sue.

Uniswap executives have vowed to fight the agency in court.

AI-Operated F-16 Jet Carries Air Force Official Into 550-MPH Aerial Combat Test (apnews.com) 113

The Associated Press reports that an F-16 performing aerial combat tests at 550 miles per hour was "controlled by artificial intelligence, not a human pilot."

And riding in the front seat was the U.S. Secretary of the Air Force... AI marks one of the biggest advances in military aviation since the introduction of stealth in the early 1990s, and the Air Force has aggressively leaned in. Even though the technology is not fully developed, the service is planning for an AI-enabled fleet of more than 1,000 unmanned warplanes, the first of them operating by 2028.

It was fitting that the dogfight took place at [California's] Edwards Air Force Base, a vast desert facility where Chuck Yeager broke the speed of sound and the military has incubated its most secret aerospace advances. Inside classified simulators and buildings with layers of shielding against surveillance, a new test-pilot generation is training AI agents to fly in war. [U.S. Secretary of the Air Force] Frank Kendall traveled here to see AI fly in real time and make a public statement of confidence in its future role in air combat.

"It's a security risk not to have it. At this point, we have to have it," Kendall said in an interview with The Associated Press after he landed... At the end of the hourlong flight, Kendall climbed out of the cockpit grinning. He said he'd seen enough during his flight that he'd trust this still-learning AI with the ability to decide whether or not to launch weapons in war... [T]he software first learns on millions of data points in a simulator, then tests its conclusions during actual flights. That real-world performance data is then put back into the simulator where the AI then processes it to learn more.

"Kendall said there will always be human oversight in the system when weapons are used," the article notes.

But he also said looked for to the cost-savings of smaller and cheaper AI-controlled unmanned jets.

The US Just Mandated Automated Emergency Braking Systems By 2029 (caranddriver.com) 286

Come 2029, all cars sold in the U.S. "must be able to stop and avoid contact with a vehicle in front of them at speeds up to 62 mph," reports Car and Driver.

"Additionally, the system must be able to detect pedestrians in both daylight and darkness. As a final parameter, the federal standard will require the system to apply the brakes automatically up to 90 mph when a collision is imminent, and up to 45 mph when a pedestrian is detected." Notably, the federal standardization of automated emergency braking systems includes pedestrian-identifying emergency braking, too. Once implemented, the NHTSA projects that this standard will save at least 360 lives a year and prevent at least 24,000 injuries annually. Specifically, the federal agency claims that rear-end collisions and pedestrian injuries will both go down significantly...

"Automatic emergency braking is proven to save lives and reduce serious injuries from frontal crashes, and this technology is now mature enough to require it in all new cars and light trucks. In fact, this technology is now so advanced that we're requiring these systems to be even more effective at higher speeds and to detect pedestrians," said NHTSA deputy administrator Sophie Shulman.

When a Politician Sues a Blog to Unmask Its Anonymous Commenter 79

Markos Moulitsas is the poll-watching founder of the political blog Daily Kos. Thursday he wrote that in 2021, future third-party presidential candidate RFK Jr. had sued their web site.

"Things are not going well for him." Back in 2021, Robert F. Kennedy Jr. sued Daily Kos to unmask the identity of a community member who posted a critical story about his dalliance with neo-Nazis at a Berlin rally. I updated the story here, here, here, here, and here.

To briefly summarize, Kennedy wanted us to doxx our community member, and we stridently refused.

The site and the politician then continued fighting for more than three years. "Daily Kos lost the first legal round in court," Moulitsas posted in 2021, "thanks to a judge who is apparently unconcerned with First Amendment ramifications given the chilling effect of her ruling."

But even then, Moulitsas was clear on his rights: Because of Section 230 of the Communications Decency Act, [Kennedy] cannot sue Daily Kos — the site itself — for defamation. We are protected by the so-called safe harbor. That's why he's demanding we reveal what we know about "DowneastDem" so they can sue her or him directly.
Moulitsas also stressed that his own 2021 blog post was "reiterating everything that community member wrote, and expanding on it. And so instead of going after a pseudonymous community writer/diarist on this site, maybe Kennedy will drop that pointless lawsuit and go after me... consider this an escalation." (Among other things, the post cited a German-language news account saying Kennedy "sounded the alarm concerning the 5G mobile network and Microsoft founder Bill Gates..." So what happened? Moulitsas posted an update Thursday: Shockingly, Kennedy got a trial court judge in New York to agree with him, and a subpoena was issued to Daily Kos to turn over any information we might have on the account. However, we are based in California, not New York, so once I received the subpoena at home, we had a California court not just quash the subpoena, but essentially signal that if New York didn't do the right thing on appeal, California could very well take care of it.

It's been a while since I updated, and given a favorable court ruling Thursday, it's way past time to catch everyone up.

New York is one of the U.S. states that doesn't have a strict "Dendrite standard" law protecting anonymous speech. But soon the blog founder discovered he had allies: The issues at hand are so important that The New York Times, the E.W.Scripps Company, the First Amendment Coalition, New York Public Radio, and seven other New York media companies joined the appeals effort with their own joint amicus brief. What started as a dispute over a Daily Kos diarist has become a meaningful First Amendment battle, with major repercussions given New York's role as a major news media and distribution center.

After reportedly spending over $1 million on legal fees, Kennedy somehow discovered the identity of our community member sometime last year and promptly filed a defamation suit in New Hampshire in what seemed a clumsy attempt at forum shopping, or the practice of choosing where to file suit based on the belief you'll be granted a favorable outcome. The community member lives in Maine, Kennedy lives in California, and Daily Kos doesn't publish specifically in New Hampshire. A perplexed court threw out the case this past February on those obvious jurisdictional grounds....

Then, last week, the judge threw out the appeal of that decision because Kennedy's lawyer didn't file in time — and blamed the delay on bad Wi-Fi...

Kennedy tried to dismiss the original case, the one awaiting an appellate decision in New York, claiming it was now moot. His legal team had sued to get the community member's identity, and now that they had it, they argued that there was no reason for the case to continue. We disagreed, arguing that there were important issues to resolve (i.e., Dendrite), and we also wanted lawyer fees for their unconstitutional assault on our First Amendment rights...

On Thursday, in a unanimous decision, a four-judge New York Supreme Court appellate panel ordered the case to continue, keeping the Dendrite issue alive and also allowing us to proceed in seeking damages based on New York's anti-SLAPP law, which prohibits "strategic lawsuits against public participation."

Thursday's blog post concludes with this summation. "Kennedy opened up a can of worms and has spent millions fighting this stupid battle. Despite his losses, we aren't letting him weasel out of this."

The same cannot be said for common lithium-ion materials like cobalt and nickel.

Sodium-ion tech has received heightened interest in recent years as a more reliable, potentially cheaper energy storage medium. While its energy density lags behind lithium-ion, advantages such as faster cycling, longer lifespan and safer, non-flammable end use have made sodium-ion an attractive alternative, especially for stationary uses like data center and EV charger backup storage. US Official Urges China, Russia To Declare AI Will Not Control Nuclear Weapons 85

Senior Department arms control official Paul Dean on Thursday urged China and Russia to declare that artificial intelligence would never make decisions on deploying nuclear weapons. Washington had made a "clear and strong commitment" that humans had total control over nuclear weapons, said Dean. Britain and France have made similar commitments. Reuters reports: "We would welcome a similar statement by China and the Russian Federation," said Dean, principal deputy assistant secretary in the Bureau of Arms Control, Deterrence and Stability. "We think it is an extremely important norm of responsible behaviour and we think it is something that would be very welcome in a P5 context," he said, referring to the five permanent members of the United Nations Security Council.

Florida Bans Lab-Grown Meat 191

Florida Gov. Ron DeSantis signed a bill this week banning and criminalizing the manufacture and sale of lab-grown meat in the state. From a report: The legislation joins similar efforts from three other states -- Alabama, Arizona and Tennessee -- that have also looked to stop the sale of lab-grown meat, which is believed to still be years away from commercial viability. "Florida is fighting back against the global elite's plan to force the world to eat meat grown in a petri dish or bugs to achieve their authoritarian goals," DeSantis said. "We will save our beef."

Lab-grown meat, also known as cultivated meat, has attracted considerable attention in recent years as startups have raised millions of dollars to improve the technology meant to create a climate-friendly alternative to traditional meat sources. Cultivated meat is usually grown in a metal vessel from a sample of animal cells. They multiply in a container called a bioreactor while being fed with water, amino acids, vitamins and lipids -- a process that can be difficult to do at scales large enough to create enough food for commercial sale. Still, some companies have made strides, with two California startups receiving approval from U.S. regulators last year to sell lab-grown chicken. Those companies said Florida's bill stifles innovation in a space that is becoming competitive globally.
