Apple Watch Import Ban Temporarily Stopped By US Appeals Court (cnbc.com) 17

An appeals court on Wednesday temporarily stopped the import ban on Apple's latest Apple Watches, allowing the company to continue selling the wearables. CNBC reports: Apple stopped selling its Series 9 and Ultra 2 watches last week in response to an International Trade Commission order in October that found the blood oxygen sensor in the devices had infringed on intellectual property from Masimo, a medical technology company that sells to hospitals. "The motion for an interim stay is granted to the extent that the Remedial Orders are temporarily stayed," a court filing Wednesday said.

On Monday, the Biden administration declined to pause the ITC ban. Apple filed the appeal with the U.S. Court of Appeals for the Federal Circuit on Tuesday. The company continues to seek a longer stay. The ITC will need to reply by Jan. 10. The stay means Apple may be able to sell the latest models of one of its most important products during the busiest time of the year. Apple Watch sales are reported as part of Apple's wearables business, which reported $39.8 billion in sales in Apple's fiscal 2023, which ended in September.

      Sounds like you haven't read the patent. It's totally dumb.

      • Can you be more specific? By "it", which patent that apple was found to be in violation of are you referring to? And within that patent, which claim(s) that apple was determined to have violated are you talking about? And why is the particular patent you determined to be "dumb" the only one that is relevant to you, given they were found to be in violation of another as well?

      Or you did and just completely made up crap that clearly isn't and can't be true.
      Probably the latter.

      No overruling the courts happened, nor was asked for, nor can happen even if it was.

      It was the court itself that decided Masimo must license their patent and is preventing them from sitting on it.
      That was the ruling.

      Under no legal situation can Masimo now prevent Apple from licensing their patent.

    • I'm not so sure. I read up on the history, the ban is based on debateable info. Such as Apple hiring talent from a company that worked with Masimo, not Masimo itself. No apparent trade secrets were transferred, and even the idea itself had prior art just not put into a smart watch which might not actually hold up on appeal for the patent because it might be considered obvious to take a wrist strapped sensor and put it in an already on your wrist watch. From what I can tell, the only thing Masimo might h

        That matches my understanding as well. I miss the old days of Slashdot when we would have had real factual commentary from people directly knowledgeable of the workings (with an anonymous coward at +5 informative)
        • we used to not give so much weight to ACs. Now you can cower behind the AC and say what you want and people vote it up.

          I don't really have any knowledge except what was published, so I'm interested to see how this plays out.

          I have a strange relationship with Apple. I love the products, I've never had a better laptop than my M2 MBP16. However, the company itself is sort of a big evil empire. Not google or facebook evil, but not so different that you might confuse them with the good guys lol.

  • Why not require Apple to remove the app that checks your blood oxygen saturation level, and then the iWatches can be still used to do everything else.
