Judge Orders Tim Cook and Craig Federighi To Testify in Epic Case (appleinsider.com) 33

A judge has ordered Apple to produce Tim Cook and Craig Federighi to testify for the Apple versus Epic lawsuit, and they must produce required documents before the next hearing. From a report: The Apple versus Epic lawsuit continues as publicly filed court documents tell us a bit more about the upcoming trial. Epic wants Apple to produce extensive documentation surrounding the App Store and its operations, but there has been some deliberation as to how extensive this data needs to be, and who will present it. The document filed states that Apple will have a large burden placed on them to gather much of what Epic is asking for. The court sides with Apple here stating that Epic need not ask for more amplifying data unless absolutely necessary. The most important part of the court filing is who's going to be made available to represent Apple. Epic has requested that Tim Cook and Craig Federighi be made available for the hearing. Apple says that Tim Cook will be available, but requests his deposition be limited to four hours. Apple also requested that Eric Neuenshwander, who runs the App Store and reports to Craig Federighi, be present instead.

  • Make the victim waste resources, tie up executives in courts, until they just give up. We have seen this in every patent troll case. It is cheaper just to pay.

    Epic makes money. They can publish elsewhere. This is about them wanted to get around Apple restrictions that keep them from having kids rob their parents credit cards.

      I think in terms of money to waste in court Apple has the advantage. Fortnite is a Fad game, like all games that will be popular for a few years than when the next generation of kids come in they don't want to play that game because something else will be more interesting for them.

          And both of those would be wrong. Apple makes more money than Epic. Epic is 10% sized Apple's assets. Epic is a rat trying to be a fatter, greedier rat.

    • That's all you need to do to tie up an executive in the courts? File a lawsuit? I'm kind of suspicious that judges will commonly order anyone other than a person (Apple corporation)'s legal counsel to be in court, considering Epic isn't suing Tim Cook himself. Making a CEO take time off from golfing or yelling at people [cnbc.com] or firing them in the elevator [allenpike.com] seems to be a privilege mostly restricted to Congress.

      • Back in the day on issue with the .com was that everyone was trying to figure what was legal. Yes I did see more than one major company have to waste resources on what ultimately were frivolous lawsuits. As we have seen in past month with 50 lawsuits, each has to be answered and each consumes large resources, no matter how frivolous

    We know MacOS is not a big market vs. PC gaming, but mobile is another story.

    • Craig Federighi is an operating system software expert. He can say he does not look after the App Store, while easily arguing how the centralised repository model helps protect customers beyond what simple kernel-level protections can, within the context of protecting iOS. Tim Cook is no fool either.

      Epic are being stupid. They should have targeted Apple, Google Microsoft, Sony and Nintendo all at the same time. They could at least have sued them all for price collusion or something.

        If they had done that, Microsoft would probably just make an alternative to Unreal Engine and give it away for free.

        The difference between Apple and the console makers is that Epic actually makes a lot of money from the console makers. I doubt Fortnite for iOS sells many copies, and no one buys a Mac if gaming is a priority. However, if they force Apple to open up the iPhone, they could potentially make a lot of money if their competing app store took off. From their moves so far, it appears they believe th

        Playing iOS games on M1 is mostly not possible as they mainly require multitouch for controls which is not possible on a Mac. It may change for some games (which may be the most popular ones) but it won't happen for a vast majority.
        • What about the multi-touch MacBook trackpads and the external Magic Trackpad that they sell separately?

            A lot of iOS games use controls that are in fixed places on the screen. More than one of those places on the screen can't be touched at the same time. It doesn't matter that the touchpad supports multiple touches as they are not mapped as absolute coordinates to the screen.

            Even worse, some (racing) games use the accelerometer so they are a complete no-go.
