These specific investigations centered around Vista's compliance with Google's concerns surrounding search tools for the desktop. From the article: 'Preliminary testing shows the new version, which will let Vista users set a competing search program as their default and see it in the Windows Start menu, works as expected. The changes will be available in Service Pack 1, a package of upgrades and fixes expected in the first quarter of 2008, the department said. The department also said in its report that it is looking into differences between original technical documentation and rewritten versions from Microsoft, and that it is testing fixes Microsoft made to some software.'"

The nation now plans to send a manned mission to the moon by 2025 and establish a permanent base shortly thereafter. 'According to our estimates, we will be ready for a manned flight to the moon in 2025,' Roskosmos chief Anatoly Perminov told state news agency RIA Novosti. A station that could be inhabited could be built there between 2027 and 2032, he said. While Russia will be refurbishing existing spacecraft, the U.S. is taking a different approach after the space station is finished and plans to scrap the space shuttle program in favour of a new kind of spaceship to be called Orion."

He quotes ALLIED TUBE & CONDUIT CORP. v. INDIAN HEAD, INC., 486 U.S. 492 (1988), which says 'What petitioner may not do (without exposing itself to possible antitrust liability for direct injuries) is bias the process by, as in this case, stacking the private standard-setting body with decision makers sharing their economic interest in restraining competition.'"

The states want oversight extended at least through early next year. 'The justice department said in its report that while Microsoft's operating system market share hasn't dropped because of the consent decree, "it would misapprehend the purpose of the Final Judgments to rely on these facts to argue that the Final Judgments have been ineffective. Microsoft was never found to have acquired or increased its monopoly market share unlawfully." In its report, Microsoft directly countered California's claims and said, the "Final Judgments were never designed to reduce Microsoft's share in any putative market."'"

GamePolitics is serving up email transcripts that show increasing tension between Jack Thompson and 2K Games. The two parties have been acting at least vaguely civilly towards each other since an April settlement. A taunting, factually incorrect email from Jack to 2K (and other parties) has set things off again. 2K's response is to-the-point: "We demand that you cease making these false statements about our online sales practices. Your dissemination of knowingly false statements for the purpose of adversely affecting Take-Two's business is actionable and we reserve all of our rights under the settlement agreement and state and federal law. Not only are your statements clearly false, but they were made in an email publicly disseminated to both the FTC and the press. Please be assured that I am happy to answer any questions you have concerning our practices in a private communications. It is for this very reason that our settlement agreement designates a legal contact for you at Take Two."

jon_cooper writes "After recent setbacks in the RIAA's lawsuits, the Australian Federation Against Copyright Theft (AFACT) has decided to try a different approach in Australia - they want ISPs to do their dirty work for them. Australian ISPs, though, have soundly rejected calls from AFACT to slow down or terminate user accounts that AFACT has determined are being used to distribute copyrighted works. Telstra (one of the larger ISPs in question) had this to say: 'We do not believe it is up to the ISPs to be judge, jury and executioner in relation to the issue when the content owners have any number of legal avenues to pursue infringements.'"

Groklaw Reader writes "Just days after Microsoft's attempt to buy the Swedish vote on OOXML came to light, SIS declared its own vote invalid. The post at Groklaw references a ComputerWorld article with revelations from Microsoft: 'Microsoft Corp. admitted Wednesday that an employee at its Swedish subsidiary offered monetary compensation to partners for voting in favor of the Office Open XML document format's approval as an ISO standard. Microsoft said the offer, when discovered, was quickly retracted and that its Sweden managers voluntarily notified the SIS, the national standards body. "We had a situation where an employee sent a communication via e-mail that was inconsistent with our corporate policy," said Tom Robertson, general manager for interoperability and standards at Microsoft. "That communication had no impact on the final vote." ...'"

'The Justice Department attorneys argue McConnell's statements did nothing to change the fact that it hasn't ever confirmed any of the activities alleged by the class action plaintiffs--and has, in fact, denied the existence of any sort of "dragnet." The arguments made by the class action plaintiffs rest on nothing but "speculation," the attorneys wrote. In the Justice Department's view, litigating the case would still require exposing how the program actually does work--which, it says, would in turn endanger national security.'"

Reader r writes with news from San Francisco that Earthlink has backed out of contract negotiations to blanket the city with free Wi-Fi, citing money problems. Seems like only yesterday that Chicago's Wi-Fi deal fell apart for much the same reason. Quoting: "The contract, which was three years in the making, had run into snags with the Board of Supervisors, but ultimately it was undone when Atlanta-based EarthLink announced Tuesday that it no longer believed providing citywide Wi-Fi was economically viable for the company... EarthLink spokesman Jerry Grasso said that EarthLink was willing to work with San Francisco but had decided that it 'was not willing to work in the business model where EarthLink fronts all the money to build, own and operate the network.'"

Next Generation reports that the ESRB is flatly refusing Leland Yee's request to further outline their logic behind Manhunt 2's re-rating. Says organization president Patrica Vance, "It is simply not our place to reveal specific details about the content we have reviewed, particularly when it involves a product yet to be released. What can be said is that the changes that were made to the game, including the depictions themselves and the context in which those depictions were presented, were sufficient to warrant the assignment of an M (Mature 17+) rating by our raters."

The story cites contract disputes and the falling price of residential broadband as reasons for the talks collapsing. 'Chicago officials had intended that the city would offer infrastructure, but no cash, to a carrier that would use its own funds to build the network here. EarthLink and AT&T Inc. submitted proposals to the city, but after months of negotiations the parties were unable to reach agreement. The companies sought a commitment from Chicago to be an "anchor tenant," agreeing to pay to use the Wi-Fi network to support city services, but the city declined ... Even if Chicago declines to back a municipal wireless network, city residents soon will gain more Internet connection options. Sprint Nextel Corp. is building a wireless WiMax network here that is due to offer service next spring.'"

A thousand pages of restricted documents released under the Freedom of Information Act were required to determine the veracity of this clandestine project, Wired News reports. Called the Digital Collection System Network, it connects FBI wiretapping rooms to switches controlled by traditional land-line operators, internet-telephony providers and cellular companies. It is intricately woven into the nation's telecom infrastructure. From the article: 'FBI wiretapping rooms in field offices and undercover locations around the country are connected through a private, encrypted backbone that is separated from the internet. Sprint runs it on the government's behalf. The network allows an FBI agent in New York, for example, to remotely set up a wiretap on a cell phone based in Sacramento, California, and immediately learn the phone's location, then begin receiving conversations, text messages and voicemail pass codes in New York. With a few keystrokes, the agent can route the recordings to language specialists for translation.'"

After much hemming and hawing, Take-Two appears to have secured an 'M' rating for Manhunt 2 from the ESRB. The title is now due in stores around Halloween. The reversal of fortunes for the much-maligned title has prompted a number of conspiracy theories and outright outrage from groups 'fighting' videogame violence. Well-known commentator on the subject and California State Senator Leland Yee is demanding more transparency from the ESRB as a result of this decision. From GamePolitics' coverage: "Parents can't trust a rating system that doesn't even disclose how they come to a particular rating. The ESRB and Rockstar should end this game of secrecy by immediately unveiling what content has been changed to grant the new rating and what correspondence occurred between the ESRB and Rockstar to come to this conclusion. Unfortunately, history shows that we must be quite skeptical of these two entities."

One of Gonzales' main opponents praised his decision stating that: "'For the previous six months, the Justice Department has been virtually nonfunctional and desperately needs new leadership,' said the Schumer statement. Indian writes to mention that after an intense meeting at Delhi's Manak Bhawan the 21-member technical committee has decided to vote against Microsoft's Open Office Extensible Mark Up Language (OOXML) standard at the September meeting of the International Standards Organization (ISO). "Microsoft said it respects the government's decision. 'There were only three options "Yes", "No" and "Abstain" to be taken and we respect the government's decision,' Microsoft's legal affairs head Rakesh Bakshi said. He, however, added that India's 'No' vote will become a 'Yes' if Microsoft is able to resolve all technical issues with OOXML before the ballot resolution committee of ISO."
